| dc.description.abstract | Burundi has been a party to the ACRWC since its ratification on June 28, 2004. It is therefore bound to implement the provisions of this Charter. This thesis is entitled “Burundi, at the test of implementing the ACRWC : Case of the articles 4 al.2, 6, 7 et 20 al.2 lit.a”. Its aim is to verify whether Burundi is complying with the obligations arising from ratification of the ACRWC in terms of birth registration, child participation and the enjoyment of socio-economic rights. This thesis uses documentary techniques, site visits, focus groups to collect data and analysis through exegesis, casuistry and comparison. The results of our research show that in Burundi, legal and administrative practices in the field of birth registration are not in line with the provisions of the ACRWC and the ACERWC directives. As a result, universal birth registration has not been achieved. Moreover, the participation of the child victim before the judge is not respected, and the judgment handed down without his or her opinion does not award damages. Finally, the enjoyment of socio-economic rights is highly dependent on the financial situation of households. Burundi does not respect its obligation to intervene materially to enable children whose parents are unable to provide for them to enjoy their rights to food, housing, clothing, health and education. As a result, children living with their mothers in prison and children living on the streets either do not enjoy these rights, or enjoy them only with difficulty. | |
